At the time of delivery of the boat, the lessee will deposit an amount of €500 in cash or card, as a deposit. This deposit will be returned upon inspection and return of the boat in perfect condition.

The lack of any of the indicated documents within the established period will determine the ineffectiveness of the contract, without prejudice to which the amounts delivered up to that moment by the lessee will remain the property of the lessor.

• MINIMUM QUALIFICATION REQUIRED

• DELIVERY AND RETURN OF THE BOAT

The boat will be delivered to the port of El Masnou or Port Olimpic, it will be delivered clean, with a full fuel tank, with the rescue luggage in perfect condition and ready for navigation.

The return of the boat will be carried out in the same port. In the event that the boat is left in a place other than the one agreed upon, the lessee will be responsible for the cost of all expenses, damages and losses that this causes. will be deducted from the deposit, the rest of the deposit will be returned once the boat is in the base port and it has been verified that everything is correct.

The boat must be returned with a full fuel tank, otherwise the Liters consumed plus a penalty of €30 per trip to refuel will be charged.

The boat must be returned clean, without leaving objects or garbage bags, containers, etc. Otherwise, an amount of €35 will be deducted for cleaning. of the bail.

• EXTENSION OF THE LEASE

In the event that the lessee wishes to extend the rental of the boat, overtime, he must notify the Lessor with reasonable notice (Minimum 3 hours before its return) and request his approval of the extension. The cost of extra hour/s will depend on season and vessel.

In the event that the lessee wishes to extend the rental of the boat, for extra days, the lessee must check the availability with the lessor and request their approval of the extension, indicating the new return date, the extra day will have a cost, depending on day/s and season and vessel.

• CHANGE OF RESERVATION

For any change in the boarding date planned in the reservation, you will have to be notified via emailinfo@soladecboatrental.esor by calling 691.037.422, at least 15 days in advance to consult a possible change. If there is no availability on the new date indicated by the lessee, other options will be given depending on the availability of the boat. If an agreement is not reached, the amount paid will be returned. If it is not possible to reach an agreement and you give notice between 15 and 7 days of the reserved date, 30% will be withdrawn and if you notify before 7 days, 50% of the reserved rental amount will be withdrawn as management fees.

• USE OF THE BOAT

The Lessor has the right to cancel the contracted rental if he observes that the skipper does not have adequate knowledge to govern the boat and poses a danger to him, his crew and/or third parties.

The lessee will use the leased vessel exclusively for recreational or pleasure cruising, and it is strictly prohibited to use the vessel for any type of commercial activity sanctioned by current legislation, subletting or transferring the leased vessel. It is prohibited to embark weapons, narcotics, contraband in general, merchandise, paying passengers.

The lessee agrees not to transport a number of people greater than the authorized seats on the boat.

The lessee is obliged to use the boat with the diligence of a good navigator, respecting the common navigation rules, as well as those established or given by the competent authority, being responsible for any breach of the same.

The lessee is obliged to remain or go to port in the event of a weather report that announces danger. Likewise, you agree not to leave the boat, at any time, without adequate supervision on board.

The lessee is obliged to complete and pay the procedures and expenses of customs and external ports.

The lessee is obliged to faithfully follow the instructions in the manual for use and use of the boat, as well as all the material delivered along with the list of on-board inventory.

Without prejudice to the foregoing, the lessee will promptly inform the lessor of any incidents that have occurred during the voyage; especially those that may affect the safety and maintenance of the vessel and the contacts that may occur with the bottom.

Any infraction committed by the lessee or his crew will be the responsibility of the lessee. Soladec Servicios Integrales SL reserves the right to apply a penalty, depending on the infraction committed.

The boat has comprehensive insurance.

• PERSONAL ITEMS

The lessor is not responsible for the loss, destruction and/or damage of personal property deposited or stored on the boat.

CANCELLATIONS

In the event that the lessee cancels the reservation, he must notify the lessor at least 15 days in advance of boarding, in writing to the email info@soladecboatrental.es If he notifies between 15 and 7 days of the reservation date, the reservation will be withdrawn. 30% and if you give 7 days notice, 50% of the rental amount of the reserved will be withdrawn as management costs.

In the case of adverse weather conditions that make navigation difficult, such as,

Strong wind forecast with speeds greater than 20 knots.

Intense rain forecast for a period greater than 30% of the day.

In these cases, rentals of 1 to 2 days will require a change of day, depending on availability and the same season.

In rentals of 3 or more days, if the weather conditions are adverse for 30% of the rental, those consecutive days will be compensated, according to availability and the same season.

The tenant has the right to cancel the reservation if the landlord arrives 1 hour later than agreed or does not show up, the amount paid to confirm the reservation will not be returned.

• NAVIGATION LIMITS

The rented vessel may only navigate by sea at a maximum distance indicated by the current navigability certificate of the vessel itself.

• DAMAGES AND ACCIDENTS

The Lessee must immediately inform the lessor in the event of any damage, collision, breakdown or deterioration of the vessel, regardless of the causes, to take the appropriate action.

The Lessee must inform the Lessor immediately of the necessary repair or need for spare parts. Each repair or repair without authorization by the Landlord will be charged directly to the Tenant.

The expenses incurred for the urgent repair of the boat, which are not a consequence of improper misuse, for which the lessee is not responsible, will be reimbursed by the lessor, upon presentation of the appropriate invoice.

In the event that an accident, accident, loss of the boat occurs and for any reason the insurance company does not take responsibility for all or part of the damages, expenses or civil liability caused, the lessee must face all of them at his own expense. charge, expressly releasing the lessor from any responsibility.

Any damage, loss or damage caused by improper use by the Lessee and his crew will be his responsibility and will bear the costs incurred. In the event of accidents, damages or breakdowns with the intervention of third parties, the lessee must make the appropriate declaration in this regard before the competent authorities, informing the lessor in writing of the incident that occurred, including the personal and boat data of the third party.

The company Soladec Servicios Integrales SL is not responsible for personal accidents in aquatic or underwater sports.

• RIGHTS OF THE LESSEE.

The lessor undertakes to deliver the boat in perfect working order, with navigation equipment, clean and ready to sail, at the agreed place, date and time.

In the event that, due to force majeure, which may include the breakdown of the vessel or risk to the passengers, it cannot be delivered, the lessor undertakes to inform the lessee immediately, as well as to inform the all possible means to solve the problem and/or try to find another rental boat of the same or higher category, give you the option of changing the day with the same conditions, or refund the amount paid. If it is not possible to reach an agreement, the landlord may have the courtesy of giving a discount on the next rent.

• WATER GAMES (IN THE CASE OF CONTRACTING, AN ANNEX WILL BE ATTACHED)

• BOAT EQUIPMENT
